The 37-year-old television assignment editor needed to breast-feed her 7-month-old daughter and could not leave the public swimming pool because her 5-year-old son was in the water.
The ensuing debate is -- to women's rights advocates -- a clarifying look at the contradictory nature of a culture that shudders in horror at the sight of a breast with a suckling baby while celebrating the for-adults-only version of the breast in every possible forum.
It is an attitude that was supposed to have been put to rest in 1997, according to advocates of breast-feeding, when California passed legislation authorizing women to expose a bosom so they can nurse anywhere they are allowed to be.
But, as Tabb's case shows, not everybody is comfortable with the notion.
It all started on March 4, when Tabb nonchalantly began nursing her daughter, Meleah, as she watched her son, Aaron, in the pool at the Osher Marin Jewish Community Center in San Rafael. Within minutes, a manager walked up to Tabb with a towel and asked her to "cover up."
"She was breast-feeding in a very public place," explained Patty Gessner, the center's marketing director. "A manager handed her a towel and very politely asked her to cover up because she was in full view of a senior exercise swim class. A member who was at the pool complained."
Tabb was flabbergasted because she had often breast-fed her baby at the center, and nobody had ever objected. She was told, and Gessner confirmed, that if somebody complains about breast-feeding , the center's policy is to ask the woman to cover up or otherwise be more discreet.
Outraged, Tabb canceled her membership and sought the advice of a lawyer, who has written a letter demanding that the community center revise its policy or risk legal action.
"I really want them to change their policy, because it's wrong and illegal," Tabb said. "It's surprising, especially given where we live, in liberal, progressive Marin County."
It is a situation that has been repeated frequently over the years despite the law, according to Nancy Solomon, the senior staff attorney for the California Women's Law Center in Los Angeles.
In fact, she and others say, most breast-feeding women still hustle to a private area at feeding time or, if they can't find one, hold off feeding their babies. And yet, Solomon said, a person can scarcely walk past a billboard or turn on a television set without being confronted by depictions of cleavage.
It is exactly this kind of hypocritical public reaction to breast-feeding that California Civil Code Section 43.3 was designed to discourage, she said.
"A mother," the law says, "may breast-feed her child in any location, public or private, except the private home or residence of another, where the mother and child are authorized to be present."
In 1997, then-Gov. Pete Wilson sought to remove the stigma of public breast-feeding. "By signing this bill," he said in a statement, "I am removing barriers of embarrassment, harassment and charges of indecent exposure when a mother breast-feeds her child in public."
Solomon contends that asking a woman to cover up violates the law.
"If a woman is going to function in society during the time she is breast-feeding, she is going to have to do it out in public," Solomon said. "A woman can't control where she is going to be when her baby wants to eat.
